Complaint at RTV Euro AGD: Consumer Rights and Letter Template (2026)

RTV Euro AGD is one of the largest electronics and home-appliance retail chains in Poland. Whether you bought a fridge, washing machine, TV or smartphone — you have 2 years of statutory protection under the Consumer Rights Act. The manufacturer's warranty and RTV Euro AGD's internal procedures do not replace your statutory rights.

Legal basis for a complaint at RTV Euro AGD

Art. 43b of the Consumer Rights Act obliges the seller to deliver goods that conform to the contract. If a defect — mechanical, electrical or factory — appears within 2 years of purchase, you can file a complaint directly with RTV Euro AGD as the seller, without contacting the manufacturer.

Throughout the 2-year period there is a presumption that any defect existed at the time of purchase (Art. 43c §1 CRA). The store must prove the defect was caused by you — not the other way around.

What you can demand

Under Art. 43d §1 of the Consumer Rights Act you may demand:

  • Repair — free of charge, within a reasonable time, without undue inconvenience to you
  • Replacement with an identical or equivalent defect-free product

If repair or replacement is impossible, the store refuses, or the defect returned after repair — you have the right to a price reduction or refund (withdrawal from the contract) under Art. 43e §1 of the Consumer Rights Act.

14-day response deadline

RTV Euro AGD has 14 calendar days to respond to your complaint (Art. 7a CRA). Counting starts from the day the letter is delivered. Silence means the complaint is accepted by law.

How to file a complaint at RTV Euro AGD

  • Prepare proof of purchase: receipt, invoice, or order confirmation from your rtveuroagd.pl account
  • Describe the defect: date of occurrence, symptoms, whether the appliance was used as instructed
  • State your demand clearly: repair, replacement or refund
  • Cite Art. 43b and Art. 43d §1 of the Consumer Rights Act
  • Send by email or submit in person at the store, keeping a copy and proof of receipt

For large appliances (washing machine, fridge, dishwasher) the store must arrange collection of the faulty item at its own cost — you do not need to deliver it or pay for transport.

Typical responses from RTV Euro AGD and how to handle them

"Please contact the authorised manufacturer service centre."
This is incorrect practice. You have the right to file a complaint with the store. Using the manufacturer's service is your choice, not an obligation.

"The repair is outside the warranty."
The manufacturer's warranty is separate from your statutory rights. Your non-conformity rights last 2 years regardless of the manufacturer's warranty terms.

"The defect was caused by use."
The store must prove this with a technical expert report. A verbal or email claim is insufficient. Until an expert report is produced, the presumption of Art. 43c §1 CRA applies.

Extended warranty at RTV Euro AGD

Many customers buy RTV Euro AGD's extended warranty. Do not give up your statutory rights in favour of the extended warranty. Treat the extended warranty as a supplement, not a replacement. If a defect falls within the 2-year statutory period — use your statutory complaint rights.

Yes. You have 2 years from the date you received the goods. One year from purchase is still within the statutory period. File a complaint with RTV Euro AGD citing Art. 43b of the Consumer Rights Act.

RTV Euro AGD demands an expert assessment at my cost before accepting the complaint. Is this legal?

No. The store cannot require you to cover the cost of an assessment before processing a complaint. If the store wants an assessment, it commissions one at its own expense. You do not pay anything upfront.

Do I have to bring the washing machine to the store during the complaint?

No. For large appliances the store must arrange collection of the faulty item at its own cost and without undue inconvenience to you. You do not have to deliver a washing machine or fridge to the store.

RTV Euro AGD offered a shopping voucher instead of a refund. Do I have to accept it?

No. If you demand a cash refund under Art. 43e §1 CRA, the store must transfer the funds to your account. A voucher is a voluntary commercial offer.
